Bliss Experiences Waiver Agreement

As with any physical activity, there is an inherent risk during participation.

This waiver is not intended as a substitute for liability insurance coverage.

Waiver and Release of Liability Express assumption of risk: 

I, the undersigned, am aware that there are significant risks involved in physical training, movement, and outdoor activities, including but not limited to, the physical training inherent to all yoga exercise activities, and that my participation in any such physical training program carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; those risks caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to physical training and athletics but are also present for volunteers and spectators.

I am aware that any of these above-mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any physical training, including this yoga program. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others. 

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration for my being allowed to participate in the activities offered, I, the undersigned hereby release Lake Tahoe Yoga, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above-mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the wellbeing of the child.

I understand that paddle boards, leashes and paddles can be potentially dangerous.  I understand that paddle boarding and swimming are strenuous activities that can cause fatigue.  I know my own limitations and will honor my body and abilities while engaging in Stand-Up Paddle Yoga.  I understand that outdoor conditions can change quickly, that waves and water temperatures can be a danger.  I understand that the further from shore I paddle, the colder the waters become and that there is an increased risk of hypothermia.  I know that life jackets are available for use.  If under 16, practitioners are required to wear a life jacket.  I am aware that learning paddling techniques and practices such as Yoga on the paddle board involve some risk of injury and I am participating with knowledge and appreciation for the risks involved.  In the case that I become uncomfortable or extremely fatigued I will share my status with my instructor and make a decision that will best serve my needs.  This may include departing from the class or discontinuing participation.  I understand that my instructor may have other participants to attend to and that his/her responsibility is to the group as a whole.

Indemnification: The participant recognizes that there is risk involved in the types of activities offered. Therefore, the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Lake Tahoe Yoga, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to the main building, and/or any area selected for training.

Arbitration & Governing Law: The laws of the states of Nevada and California shall govern this agreement (without reference to its principles of conflicts of law), and venue for any court proceeding shall be in the state of Nevada or California, and any right to jury trial shall be waived. I agree that my sole remedy for any dispute, whether in contract, tort, or otherwise, with Lake Tahoe Yoga is to submit to binding arbitration with an arbitrator within six months of the incident giving rise to the cause of action, even if that time is less than the applicable statute of limitations. In the event of arbitration, I will pay half of the costs of the arbitrator and other costs of arbitration, and I will be responsible for all of the costs for my own legal counsel. I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it I am obligated to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.

COVID-19 Precautions

 

By signing below, you are agreeing to follow our social distancing and safety protocols.

Although strict measures are being taken by Bliss Experiences LLC, to prevent the spread of COVID-19 (such as social distancing, staggered classes, and deep sanitization, etc.), the undersigned acknowledges that attending classes at Bliss Experiences LLC could result in COVID-19 infection. I agree to provide proof of vaccination or wear a mask at all times while indoors and/or unable to remain six feet distant from other people.  Accordingly, in addition to all waivers and limits on liability already agreed to by the parties and because of the COVID-19 Pandemic, the undersigned, HEREBY WAIVES AND RELEASES, indemnifies, holds harmless and forever discharges Bliss Experiences LLC, Lake Tahoe Yoga, LTD and its members, agents, employees, officers, directors, contractors, affiliates, successors and assigns, of and from any and all claims, demands, debts, prosecutions, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to participation in any of the events or activities conducted by, on the premises of, or for the benefit of, Bliss Experiences LLC, provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct, further, it is acknowledged that operation during the pandemic does not fall into these categories.

 

I also understand that the activities that I will participate in may be considered inherently dangerous and may cause serious or grievous injuries, including bodily injury, COVID-19 infection, loss of/damage to personal property and/or death. On behalf of myself, my heirs, assigns and next of kin, I waive all related claims for damages, injuries and death sustained to me or my property that I may have against Bliss Experiences LLC.

 

By this Waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, COVID-19 infection, death or damage to personal property associated with Bliss Experiences LLC, including but not limited to receiving yoga training at the facility, using the facility and its equipment in any manner, form or fashion, and practicing and/or engaging in yoga activities or other related activities on and off the premises.

I have read, understand and fully agree to the terms of this Agreement. I understand and confirm that by signing the Agreement I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 year of age or older and mentally competent to enter into this waiver.

I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am digitally signing this agreement voluntarily and recognize that my digital signature serves as complete and unconditional release of all liability.
